Motar Terms of Service

These terms govern your use of Motar. By using the app you accept them. Read section 2 first: it is the one that decides who is responsible for what.


1. Who we are

Motar is operated by MJS Technologies, a company established in Afghanistan with its registered office at Omar Street, Rishkhor, Kabul.


2. What Motar is — and what it is not

Motar is an intermediary. We connect riders looking for a trip with drivers offering one. We operate the app, we calculate a suggested fare, and we take a commission.

We do not provide transport. The contract for the journey itself is between you and the driver. The driver decides whether to accept a trip; the driver drives; the driver is responsible for the vehicle, for holding a valid licence and permit, and for driving lawfully and safely.

We are not a party to that journey. We are not the carrier, not the driver's employer, and not liable for the driver's conduct. What we are responsible for is set out in section 8.

A driver on Motar is an independent operator, or works for a fleet company registered on the platform. Nothing here creates employment between us.


3. Using Motar

You must be at least 18 and provide accurate information. Your account is yours: don't let someone else use it, and tell us if you think someone has.

Your phone number identifies your account. We verify it by SMS.

You may not use Motar to break the law, to harass or endanger anyone, to interfere with the service, or to submit false documents. We may suspend or close an account for any of these, and we will say why.


4. Drivers

To carry passengers you must give us, and keep valid, your identity document, driving licence, and any permit required for the vehicle you drive. We check these before approving you and may re-check at any time. Driving with an expired document is grounds for suspension.

You are responsible for your vehicle's roadworthiness and insurance, for your own taxes, and for complying with the traffic and transport rules that apply to you.

You decide when to work. Going online means you may be offered trips; going offline means you will not be.


5. Fares and payment

Motar calculates a suggested fare from a base amount, distance and time, using the rates in force for the area where the trip starts. A rider may propose a fare within a limited range of that figure, and a driver may accept or counter it. The fare that applies is the one both of you agree.

Fares may be paid in cash directly to the driver, or online through the app.

Cash trips: the money passes from rider to driver. We are not involved in it. Our commission is settled with the driver separately.

Online trips: we collect the fare and pass on the driver's share, keeping our commission.

The fare belongs to the driver. Our revenue is the commission, which is a percentage of the fare and is shown to drivers in the app. We may change the commission rate; if we do, we will tell drivers before it applies.

Cancellation and no-show fees may apply and are shown in the app before they are charged.


6. Ratings and conduct

Riders and drivers rate each other. Ratings help everyone decide who to travel with, and persistently poor ratings may lead to removal from the platform.

Treat the other person decently. Threats, harassment, discrimination and violence get an account closed and, where warranted, reported.


7. Safety

If you are in danger, contact the emergency services first. Then tell us.

The app records the trip, the route and the messages exchanged. We use those records to investigate reports and to cooperate with authorities where the law requires it.

Drivers give us an emergency contact. We use it only in an emergency.


8. What we are responsible for

We are responsible for operating the app with reasonable care: matching trips, calculating fares as described, handling payments we collect, and keeping your data as set out in our Privacy Policy.

We are not responsible for the journey itself — for a driver's conduct or driving, the condition of a vehicle, injury, loss or damage arising during a trip, delays, or a driver or rider failing to turn up. Those lie with the people involved.

We do not guarantee that a driver will be available, that the app will be free of interruption, or that a suggested fare will match the final one, since you and the driver agree that between you.

Nothing in these terms excludes liability that cannot be excluded under Afghan law.


9. Suspension and closing your account

You can close your account at any time by asking us.

We may suspend or close an account that breaks these terms, submits false documents, or endangers someone. Where a suspension is precautionary and turns out to be unfounded, we restore the account.

Money already earned remains payable.


10. Changes to these terms

We may change these terms. If a change materially affects you, we will tell you in the app and ask you to accept the new version before continuing. If you do not accept, you may close your account; the previous version continues to apply to trips already taken.


11. Governing law

These terms are governed by the law of Afghanistan. Disputes are subject to the courts of Kabul.
